How are the securities arranged?
Investors provide individual Loans to Valvest Finance B.V. under Dutch law. Each Loan agreement designates Stichting Zekerheden Valvest as the Security Agent, acting as the sole and collective representative of all Investors participating in the specific project.
In the event of a breach of contract by the SPV or Valvest Finance B.V., the Security Agent is empowered to act on behalf of all Investors to enforce their rights, initiate legal proceedings, and recover funds as necessary.
To further minimize risks, all operational activities—such as sourcing, construction, and management—are handled by separate entities and we do as much as we can in-house. These operational entities enter into agreements with third parties, keeping the asset-owning entity uninvolved in these agreements to minimize the risks for your investments.
